Terms & Conditions

1. Terms
These terms are to form the agreement in which you, the seller, will do business with Deebies. They are all lawfully binding, governed by the laws of England and Wales and any breach may be contested in a court of law. We may at any time update these terms and conditions by publishing new terms and conditions on our website at http://www.deebies.com/terms.html which shall constitute notice to you of any such change.

2. Our services to you
Once we receive your items we will hold them for auction at eBay.co.uk. We will prepare the auction including taking professional photographs and writing a detailed, well written description which may take up to 10 working days. Once the auction is live we will answer any questions from buyers and use your pre-signed contract (Inventory Form) to decide whether to accept or decline any reasonable offer. At the end of the auction we will collect payment from the buyer and pay any fees. We will arrange delivery to the buyer, including packaging, and deal with any returns or complaints. Once payment has cleared and the cooling off period is over, we will send payment to you less our fees. We may wait for other or all items in your batch to clear before processing payment.

3. Our Auctions
Our auctions will run according to the rules currently in force on eBay.co.uk. Preliminary discussions with you, including your signed contract (Inventory Form), will govern how the auction is held which will not be reversible. The highest price will be determined by the highest bid which is not under our control. You understand that prices for identical lots may vary according to buyer demand. Upon receipt of payment from the buyer you will pass title ownership directly to them. We will not take ownership of any item as part of this process. The rules on eBay currently allow the buyer a 7 day return window during which they may reverse the transaction. If the buyer does reverse the sale we may offer the lot to other bidders (Second Chance Offer) at a lower price.

4. Our Fees
Our fees will be as most recently published on our website at http://www.deebies.com/fees.html unless otherwise agreed in writing. Items with a Reserve Price will incur a fee and higher value listings may include a reserve price. There is a charge of £25 if you withdraw an item for sale. Withdrawn items must be collected or returned to you in 7 days or they will be sold or passed to charity.

5. Unsold Items
If your items listed as auction or buy it now (fixed price) fail to sell we will re-list them for free. However, if they fail to sell again there will be a fee to re-list. Listings with a reserve price will incur a fee to re-list. There is also a charge of £5 per day for every day we have to hold your items if they fail to sell and you wish to collect them, without exception. Alternatively, we can arrange to return your items at the minimum cost of £20 which will waive the daily charge.

6. Your Obligations
When consigning any of your items for sale, you warrant that they are your own and that you are not constrained from selling them in any way. You will inform Deebies of any defects known to you and warrant that you have not mislead them in any way. All clothes / apparel must be washed / clean. You will not offer for sale any items prohibited by eBay in their rules. You will not do or say anything which will interfere with the proper and fair progress of the auction once under way. You indemnify us for any loss or damage due to inaccuracies in your description or any actions you take which affect the auction.
7. Our Liability
We are not liable for any loss or damage - direct, consequential or loss of profit - that you may suffer as a result of this agreement. In particular we make no representation about the selling price of your items. In all cases - except where provided otherwise by statute - our absolute liability shall be limited to the selling price of your items.

8. Privacy
Deebies will not use or disclose your personal information unless you have given your permission, except for the following purposes:
1.1 to assess, operate and improve Deebies website and to perform the services for which Deebies is responsible;
1.2 to keep you informed about Deebies and its services and about this website;
1.3 for disclosure to credit reference agencies, banks and insurers;
1.4 if we are required to disclose such personal information by any applicable law, regulation or legal process.
Deebies will not sell, trade or rent your personal information to others unless you have given your permission. With your permission, Deebies will only share your personal information with carefully chosen, reputable and trustworthy third parties. Deebies will follow the relevant legal requirements and use all reasonable precautions to ensure that only responsible third parties see the personal information. However, Deebies are not responsible for any breach of security or any act or omission of third parties who receive the personal information.


Agreement
By agreeing to these terms you are entering into a legally binding contract with Deebies that may result in court proceedings being actioned against you if any breach is discovered. With all transactions you must agree to these terms and conditions before proceeding with the signing of any documents or Deebies shall assume you are in agreement.
